QD Examiners Limited (“we”, “us”) provide expert witness services and consultancy. We are a "data controller," meaning we are responsible for the personal information we process about you.


This notice applies to individuals whose personal data we process in connection with our expert witness services, including clients, instructing parties, and individuals whose documents are examined.

1. What Data We Use and Why


We only collect information necessary to perform our casework and run our business.

 
Purpose, Type of Data and Lawful Basis

 

Casework:  Names, contact details, DOB, financial records and personal/business documents.

Legitimate Interests: We have a legitimate interest in providing independent expert analysis and evidence in legal disputes. This is necessary for the administration of justice and does not override individuals’ rights and freedoms.


Special Evidence: Sensitive data such as health records, race, ethnic origin or sex.

Legal Claims: Necessary for the establishment, exercise or defence of legal claims or for processing under the authority of a court acting in its judicial capacity.


Administration: Invoices, tax returns and insurance details.

Legitimate Interests: We process administrative records to meet our legal obligations (including HMRC tax requirements) and for our legitimate interests in running and managing our business.


Website Use: IP addresses and website activity (Usage Data).

Legitimate Interests: To ensure our website functions correctly and to understand how visitors use it so we can improve our services.

We do not perform any automated decision-making or profiling using your personal data.


Sources

We usually receive your data from the legal professionals or agencies instructing us, or if you contact us directly. 


2. Sharing Your Information


We do not sell your data. We only share it when necessary:

 

  • Instructing Parties: Those who instructed us as an expert witness in your case.

  • Legal/Tax Authorities: HMRC, VAT Commissioners, or as required by a court order.

  • Internal Access: Data is only shared internally on a strict “need to know” basis. 


2A. Service Providers (Processors)

We use trusted service providers to support our business operations. This includes:

  • Google Workspace: For secure email, document storage and administration.

  • Xero: For secure cloud-based accounting, invoicing and financial record-keeping.

These providers act as data processors and only process personal data on our instructions. They are contractually required to keep your information secure and confidential.


2B. International Transfers
Google Workspace may process data on servers located outside the UK. Where international transfers occur, Google uses legally approved safeguards, including the UK Addendum to the EU Standard Contractual Clauses and other measures required under the UK GDPR. These safeguards ensure your information remains protected to UK standards.


3. How Long We Keep Your Data
We keep casework and administrative records for six years to meet professional indemnity and HMRC requirements.  Where documents relate to ongoing or potential legal proceedings, we may retain data for longer where necessary.


If data is not needed for these obligations, it is securely destroyed once the case is concluded.


4. Security
We take the security of your information seriously. We also use secure cloud storage through Google Workspace, including encryption, access controls and commercially acceptable methods to protect your information.

 

While no internet transmission is 100% secure, we take appropriate steps to safeguard your data.


5. Your Rights
Under the UK GDPR, you have the following rights:

  • Access & Correction: Request a copy of your data or ask us to correct inaccuracies. 

  • Erasure & Restriction: Request that we delete or stop using your data. 

  • Object: Challenge our use of your data based on legitimate interests. 

  • Data Portability: Request that we transfer your data to another organisation where applicable. 

You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO) (www.ico.org.uk).

6. Cookies & Third Parties
Our website uses session and preference cookies to function properly and to track traffic via Google Analytics. We use analytics cookies only with your consent via our cookie banner.


We use anonymised or pseudonymised analytics data to understand how visitors use our website. You can disable cookies in your browser settings or opt out of Google Analytics using Google’s opt-out tools.


We are not responsible for the privacy practices of external websites linked on our site.
